Welcome to Mahseer Fishing India. When you book and participate in our fishing trips, you're agreeing to the terms and conditions outlined below. Please read them carefully.

Terms and Conditions

1. Acceptance of Terms and Conditions & Required Waiver

By booking and participating in any fishing trip organized by Mahseer Fishing India (referred to hereafter as "we," "us," or "the Company"), you ("the Participant") acknowledge that you've read, understood, and agree to be bound by these Terms and Conditions.

All Participants are required to sign a separate Liability Waiver and Release Form before your trip begins. This form repeats and expands on the disclaimers and release of liability mentioned here. Your participation depends on you completing and submitting this mandatory waiver.

2. Nature of Mahseer Fishing Trips and Assumption of Risk

Our Mahseer fishing trips in India offer an immersive experience in natural, often remote wilderness environments. While we ensure comfortable accommodations like hotels or established camps for your stay, the core activity of fishing happens in wild, unpredictable riverine settings. These outdoor activities naturally involve inherent risks, challenges, and potential hazards. These can include, but aren't limited to:

  • Environmental & Natural Risks: Unpredictable river conditions, strong currents, slippery rocks, uneven terrain, sudden weather changes (like heavy rain, thunderstorms, and temperature fluctuations), natural obstacles, and potential for landslides.

  • Wildlife Encounters: Encounters with insects, reptiles, and other local wildlife.

  • Activity-Specific Risks: Injuries from fishing hooks, lines, rods, and other tackle; potential malfunctions of equipment not owned or maintained by the Company; and physical exertion that may lead to strains, sprains, or falls while wading, walking, or hiking.

  • Water-Related Risks: The possibility of drowning, hypothermia, or other water-related incidents.

  • Travel & Third-Party Risks: Delays, interruptions, or cancellations of travel (including flights, road transport) due to unforeseen circumstances. Risks linked to services provided by third-party suppliers (e.g., hotels, transportation, boats, local guides) over whom the Company has limited or no direct control.

  • Other Unforeseen Circumstances: Acts of God, natural disasters, political instability, government regulations, epidemics, pandemics, or any other event beyond the Company's reasonable control.

Your participation in any Mahseer Fishing India trip is completely voluntary, and you undertake it with the understanding of these inherent risks. You acknowledge and accept full responsibility for any and all risks, challenges, and hazards, and the possibility of personal injury, death, property damage, or loss that might result.

3. Trip Cancellation or Modification by Mahseer Fishing India

Mahseer Fishing India reserves the right to cancel, postpone, or modify any fishing trip at any time due to unforeseen circumstances, including but not limited to:

  • Bad weather conditions (e.g., heavy rain, high river levels, extreme heat) that could compromise safety or feasibility.

  • Natural disasters (e.g., floods, landslides, earthquakes).

  • Political instability, civil unrest, or security concerns in the region.

  • Not enough participants to make the trip viable.

  • Any other circumstances that, in the Company's sole judgment, could jeopardize the trip's safety or successful execution.

In such cases, we'll endeavor to offer alternative dates or a credit for a future trip. Refunds, if any, will be processed strictly in accordance with our cancellation and refund policy as outlined on this page. The Company won't be responsible for any additional costs you incur (e.g., non-refundable flights, pre-booked accommodations, visa fees, personal expenses) due to such cancellations, postponements, or modifications.

Cancellation and Refund Policy

We understand that plans can change. Here's our policy regarding trip cancellations:

Cancellation by Mahseer Fishing India:

If Mahseer Fishing India cancels a trip due to unforeseen circumstances (as outlined in Section 3 under Terms and Conditions), we will fully refund the amount you have paid to us.

Cancellation by Participant:

Our refund policy for Participant cancellations is based on the timing of your cancellation. Please note that all refunds are calculated based on the total cost of the trip, not just the initial booking amount. This policy reflects the non-recoverable costs we incur for reservations, fishing permits, transportation, staff, and other essential bookings made in advance.

  • 90 days or more before the trip start date: Full refund.

  • 60 to 89 days before the trip start date: 10% of the total trip cost is non-refundable; the remaining 90% will be refunded.

  • 30 to 59 days before the trip start date: 20% of the total trip cost is non-refundable; the remaining 80% will be refunded.

  • 10 to 29 days before the trip start date: 30% of the total trip cost is non-refundable; the remaining 70% will be refunded.

  • 3 to 9 days before the trip start date: 40% of the total trip cost is non-refundable; the remaining 60% will be refunded.

  • Less than 3 days before the trip start date, or a no-show on the day of the trip: No refund will be provided.

However, you always have the option to reschedule or postpone your trip to a future date, subject to availability, without losing your deposit amount, provided the postponement is requested well in advance.

Health and Safety

Your safety is our top priority. We implement reasonable safety measures, but due to the nature of the activity, absolute safety can't be guaranteed. You are responsible for your own safety and for following these guidelines:

1. General Safety Guidelines

  • Physical Fitness: You must be in good physical and mental health to participate. Inform us in advance about any medical conditions, allergies, or physical limitations. Consult your doctor before booking if you have any doubts about your ability to participate.

  • Listen to Guides: Always follow instructions and advice from your fishing guide and Company representatives. Their decisions about safety, itinerary, and conduct are final. Your adherence to their guidance is crucial for your safety and the well-being of the entire group.

  • Appropriate Gear: Wear suitable clothing and footwear for outdoor, river environments. Non-slip, closed-toe shoes with good ankle support are highly recommended.

  • Sun Protection: Use broad-spectrum SPF 40+ sunscreen, wear a hat with a wide brim, and sunglasses to protect yourself from the sun.

  • Hydration: Stay hydrated. Carry and drink enough water, especially during long days on the river.

  • Waders and River Crossing: If you're using waders, understand their limitations and potential risks, especially in fast-flowing water. Be extremely cautious when wading or crossing rivers. Avoid wearing waders when fishing from elevated positions (e.g., rocks or steep banks) where an accidental fall into deep or swift water could occur, as waders can significantly impede your ability to swim or float.

  • Hook Safety: Handle fishing hooks, lures, and other tackle with extreme care. Always be aware of your surroundings, especially when casting, to avoid injuring yourself or others. Keep hooks covered or secured when not in use.

  • First Aid: Your guide will carry a basic first aid kit. However, you should bring any personal medications you might need. Access to advanced medical facilities in remote areas may be limited, underscoring the importance of comprehensive travel insurance.

  • Communication: Carry a fully charged mobile phone (though signal might be limited in remote areas). Let someone know your trip location and estimated return time.

  • Alcohol/Substance Use: For your safety and the well-being of the group, we highly recommend that Participants avoid alcohol or any substances that might impair their judgment or physical ability before or during fishing activities, as maintaining clear faculties is essential in a wilderness environment.

2. Participation of Minors (Children)

Children under the age of 18 are not permitted on our fishing trips without being accompanied by their parent or legal guardian. The accompanying parent or legal guardian is solely and fully responsible for the supervision, safety, and conduct of any child participating under their care. By allowing a minor to participate, the parent or guardian accepts these terms and conditions on behalf of the minor and assumes all risks and liabilities associated with the minor's participation, indemnifying the Company against any claims arising therefrom.

Participant Responsibilities & Conduct

1. Local Laws and Customs

When participating in our trips in India, especially in remote areas, you're expected to respect all local laws, customs, and cultural sensitivities. Engagement in any illegal activities is strictly prohibited, and such actions may lead to serious consequences, including legal repercussions.

2. Code of Conduct

To ensure a positive and safe experience for everyone, we expect all Participants to adhere to the following code of conduct:

  • Respect: Show respect for your fellow Participants, our guides, local communities, and the natural environment.

  • Environmental Stewardship: Adhere to "Leave No Trace" principles by minimizing your impact on the environment. This includes proper waste disposal and protecting local flora and fauna.

  • Cooperation: Cooperate with your guides and group members.

  • Safe Behavior: Engage in safe and responsible behavior at all times. Any disruptive, unsafe, or inappropriate conduct that jeopardizes the safety or enjoyment of the group or the integrity of the trip may result in your exclusion from ongoing activities or the remainder of the trip, potentially without a refund.

Disclaimers and Liabilities

1. Disclaimer of Liability

Mahseer Fishing India, its owners, employees, agents, contractors, and representatives (together, "the Released Parties") will not be liable for any damages, injuries, losses, expenses, or claims whatsoever that arise from or are connected to your participation in our fishing trips, even if there's negligence on the part of the Released Parties.

By participating, you expressly waive and release the Released Parties from any and all liability, claims, demands, actions, and causes of action for any loss, damage, personal injury, death, or property damage you or any third party might suffer, no matter how it's caused. This includes, but isn't limited to:

  • Any accidents, incidents, or injuries that happen during the fishing trip.

  • Damage to or loss of your personal property.

  • Travel delays, cancellations, or changes to the itinerary, including those due to weather, mechanical issues, or unforeseen circumstances.

  • Losses or expenses you incur because of medical emergencies, evacuation, or unforeseen events.

  • Any actions or omissions, whether negligent or not, of third-party service providers (e.g., hotels, transporters, boat operators, local guides) arranged by or through the Company. While we try to choose reputable third-party services, we can't guarantee their performance or be held responsible for their actions, errors, or omissions.

2. No Guarantee

While we aim to provide outstanding fishing experiences and accurate information, Mahseer Fishing India makes no guarantees about the success of fishing, the number or size of fish caught, specific weather conditions, or the exact adherence to itineraries. Fishing is inherently unpredictable, and natural conditions can change rapidly. All information given about fishing prospects, trip routes, and timings are estimates based on typical conditions and past experience, and they can change without prior notice.

3. Participant Responsibilities and Indemnification

Your decision to join a Mahseer Fishing India trip is completely voluntary. You acknowledge that you've been advised to buy comprehensive travel insurance covering personal accident, medical expenses, emergency evacuation, trip cancellation/interruption, and baggage loss. It's your responsibility to ensure you have adequate insurance coverage for your entire trip.

You agree to indemnify and hold harmless the Released Parties from any and all claims, demands, losses, liabilities, costs, and expenses (including reasonable legal fees) that arise from your participation in the trip, including any claims brought by third parties because of your actions or inactions, or any breach of these terms and conditions by you.

Privacy Policy

1. Participant Data and Documentation

To make the necessary arrangements for your trip (e.g., permits, accommodations, local travel), we may require certain personal data and documentation from you. This may include, but is not limited to, your full name, nationality, date of birth, passport details (passport number, issue/expiry dates), visa information, and/or identification documents. You agree to provide accurate and complete information as requested and understand that failure to do so may impact our ability to complete your arrangements, which could unfortunately result in the cancellation of your trip, and our standard refund policy (as outlined in the Cancellation and Refund Policy section) would then apply.

2. Data Collection and Sharing

We collect personal data from you (as outlined in Section 1: Participant Data and Documentation under Privacy Policy) to facilitate your trip arrangements and for our internal record-keeping. By providing your information, you consent to its collection and use for these purposes.

To organize your trip effectively, it is necessary for us to share relevant personal data (such as your name, nationality, and passport details) with third-party service providers, including but not limited to hotels, transportation providers, and local permit authorities. This sharing is solely for the purpose of making your bookings and securing necessary permissions for your travel and activities.

Furthermore, we may be required to disclose your personal data if mandated by law, government authorities, or regulatory bodies, or if such disclosure is necessary to protect our rights, property, or safety, or the rights, property, or safety of others.

General Provisions

1. Accommodation Specifics

While most of the hotels and lodges we arrange are equipped with air conditioning, please be aware that some remote lodges or accommodations in wilderness areas may not have air conditioning due to their location or nature. We will endeavor to provide specific details about accommodation features relevant to your chosen trip package.

2. Amendments to Terms

Mahseer Fishing India reserves the right to amend these Terms and Conditions at any time without prior notice. The most current version will always be posted on our website.

3. Governing Law and Jurisdiction

These Terms and Conditions will be governed by and interpreted according to the laws of India. Any disputes that arise from these terms will be exclusively subject to the jurisdiction of the courts in India.

4. Intellectual Property

All content on the Mahseer Fishing India website, including text, images, logos, and videos, is owned by Mahseer Fishing India and protected by copyright and other intellectual property laws. Unauthorized reproduction or use of any content without express written permission is prohibited.

You agree that Mahseer Fishing India may use any photographs or videos taken by our company staff or representatives during your trip for promotional and marketing purposes, including but not limited to our website, social media, brochures, and advertisements, without further compensation to you. If you wish to opt-out of this, please notify us in writing before your trip begins.
